Website Terms of Use and Disclaimer
This website (the “Site”) is operated by the Society of Contaminated Sites Approved Professionals of British Columbia (“we”, “us”, “our” or the “Society”) and is located at csapsociety.bc.ca. By accessing or using this Site, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Site.
Use of Information by the Society
The Society collects information provided by the users of the Site in a database that the Society uses to generate follow-up messages for the Society’s use only and statistical reports concerning users of this site. The Society does not presently sell the information contained in the database of information collected from users to any third party and does not currently make any other use of such information.
Ownership and Intellectual Property
All content contained on this Site, including but not limited to all text, design, graphics, images, photographs, videos, code, and software, as well as the selection and arrangement thereof (collectively, the “Content”), is protected by copyright, trademark, and other applicable intellectual property laws. The Content is owned by or licensed to the Society.
Certain names, words, titles, phrases, logos, icons, graphics, designs or other content on this Site may constitute trade names, registered or unregistered trade-marks or service marks (collectively, “Trademarks”) of the Society or of third parties. Any unauthorized use of the Content or Trademarks appearing on this Site is strictly prohibited and may violate intellectual property rights.
Registration and Passwords
Use of certain parts of the Site is limited to certain users as specifically authorized though the issuance of a password. If such a password is issued to you, you are responsible for maintaining the confidentiality of any such password assigned to you and for damages from the use of your password, whether or not authorized by you. You agree to notify the Society of any unauthorized use of your password promptly after such unauthorized use becomes known to you. The Society shall have no responsibility or liability whosoever with respect to the unauthorized use of a password or any activities that occur through such unauthorized use.
Authorized Use of Site
This Site is for your [personal and non-commercial or internal business] use only. As a condition of your use of this Site, you agree:
(b) not to defame or disparage anybody or make comments of an obscene, derogatory or offensive manner or otherwise use this Site or the Content in a way that brings us or any third party into disrepute or causes us to be liable to any third party;

(e) not to represent or suggest that we endorse any other business, product or service unless we have separately agreed to do so in writing; and
(f) that you are solely responsible for all costs and expenses you may incur in relation to your use of this Site.
We reserve the right to prevent or suspend your access to this Site if you do not comply with any part of these terms and conditions or any applicable law.
Documents, Images, Information, and Other Materials Proprietary to Others
The content of the Site may from time to time include (1) documents, images, information, and other materials not proprietary to the Society; and (2) articles, data, information, or other elements published in newspapers, magazines, or other media or venues and may include the name, trade name, or trademark of the medium or venue in which such materials were published. Any use whatsoever of any such third-party materials is strictly prohibited unless the prior written permission of the appropriate third party has been obtained.
Managing Content and Communications
Although it is not our intention to do so, the Society reserves the right to suspend or terminate your access to all or part of the Site at any time if we have cause to do so (including, without limitation, our good faith belief that you have violated these Terms of Use) without prior notice and without liability.

This Site may contain links to third-party websites. These links are provided for your convenience only. Such websites are independent from the Society, and we make no representations or warranties regarding the content or accuracy of any third-party website. The inclusion of any link does not imply endorsement by the Society. We do not control, and are not responsible for, the content or practices of any linked site.
Website Content and Limitation of Liability
The information and materials provided on this Site are intended for general informational purposes only. While we strive to ensure the accuracy, completeness, and timeliness of the Content, the Society makes no representations, warranties or conditions of any kind, whether express or implied, in connection with the Site or its Content. This includes, but is not limited to, implied warranties or conditions of merchantability, fitness for a particular purpose, non-infringement, or that the Site or its Content will be free from errors, omissions, inaccuracies, viruses or other harmful components.

We are not responsible for the acts or omissions of any third parties, including other users of the Site or external websites linked from this Site.
To the extent permitted by applicable law, in no event shall our total aggregate liability to you for any and all claims arising out of or in connection with your use of the Site (including the downloading or use of any Content) exceed the amount paid by you, if any, to us for access to or use of the Site.

Governing Law and Jurisdiction

You agree that any legal proceedings related to these Terms of Use or your use of this Site shall be brought exclusively in the courts of Vancouver, British Columbia, and you hereby submit to the jurisdiction of such courts.
